Terms of Service — HushSafe

These Terms of Service ("Terms") govern your access to and use of the HushSafe API, dashboard, and related services (collectively, the "Service") provided by Hush Technologies, Inc.("HushSafe", "we", "us").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

HushSafe provides a tiered text content moderation API that analyzes text and returns moderation decisions, category scores, and explanations. The Service is provided for business and commercial use.

3. Acceptable Use

You agree not to use the Service to:

Circumvent or test the detection capabilities without authorization.
Transmit CSAM or content that violates any applicable law.
Resell access to the API without prior written agreement.
Reverse-engineer the moderation models or inference pipeline.
Conduct automated attacks or attempts to exhaust rate limits maliciously.

4. API Keys and Security

You are responsible for maintaining the confidentiality of your API keys. Keys are displayed only once at creation and cannot be retrieved. Revoke and reissue keys immediately if compromised. We may revoke keys that violate these Terms without notice.

5. Service Level and Availability

We target 99.9% uptime. Planned maintenance will be announced via the status page at hushsafe.com/status. We do not guarantee uninterrupted access and are not liable for downtime beyond the SLA credits specified in your plan.

6. Pricing and Billing

Billing is based on your selected plan. Overages are billed at the rates shown on our pricing page. All fees are non-refundable except as required by law or as stated in your enterprise agreement.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUSHSAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
